บทคัดย่อ (THAI) :
ปัจจุบันการเลี้ยงสัตว์เลี้ยงในเขตเมืองเพิ่มจำนวนขึ้นอย่างรวดเร็ว ปัญหาที่เกิดจากสัตว์เลี้ยง เช่น มลภาวะทางเสียง มลภาวะจากมูลสัตว์ สัตว์เลี้ยงทำอันตรายต่อผู้คนและการแพร่กระจายของเชื้อโรค ส่งผลกระทบต่อสิ่งแวดล้อม สุขอนามัยของประชาชนและเสถียรภาพทางสังคม บทความนี้ใช้การศึกษาเชิงคุณภาพเพื่อวิเคราะห์และอภิปรายความเหมือนและความแตกต่างระหว่างนโยบายการจัดการปัญหาที่เกิดจากสัตว์เลี้ยงของสาธารณรัฐประชาชนจีนและไทยโดยศึกษาผ่านมุมมองของกฎหมายระดับชาติและข้อบังคับระดับท้องถิ่น ผลการศึกษาพบว่านโยบายของทั้งสองประเทศให้ความสำคัญกับสุขภาพและความปลอดภัยของประชาชน และเน้นความรับผิดชอบหลักของเจ้าของสัตว์เลี้ยง อย่างไรก็ตาม มีความแตกต่างอย่างมีนัยสำคัญในระบบกฎหมาย ลำดับชั้นการบังคับใช้กฎหมาย บทลงโทษ และการประยุกต์ใช้เทคโนโลยีดิจิทัล สาธารณรัฐประชาชนจีนใช้รูปแบบ “รัฐบาลกลางกำหนดหลักการ เพื่อเป็นบรรทัดฐาน ส่วนรัฐบาลท้องถิ่นกำหนดกฎระเบียบเพื่อนำไปปฏิบัติ” โดยอาศัยระบบการบริหารและเทคโนโลยีดิจิทัลเพื่อการจัดการที่ดียิ่งขึ้น ในทางกลับกัน ประเทศไทยใช้รูปแบบ “กฎหมายอาญากำหนดหลักการเบื้องต้น บูรณะการร่วมกับข้อบังคับ” โดยหน่วยงานปกครองส่วนท้องถิ่นมีอำนาจในการตัดสินใจและเน้นการแก้ไขต้นเหตุของปัญหา การวิจัยนี้สามารถนำไปใช้เพื่อศึกษาประกอบการปรับปรุงนโยบายการจัดการปัญหาการรบกวนจากสัตว์เลี้ยงในทั้งสองประเทศและส่งเสริมการอยู่ร่วมกันอย่าสันติและถูกสุขอนามัยระหว่างมนุษย์และสัตว์เลี้ยงได้

Abstract :
Currently, the number of pets in urban areas is increasing rapidly. Problems arising from pets, such as noise pollution, animal waste pollution, harm to people, and the spread of diseases, impact the environment, public health, and social stability. This qualitative study analyzes and discusses the similarities and differences between pet-related management policies in People’s Republic of China and Thailand, examining them through the lens of national and local laws and regulations. The findings indicate that both countries prioritize public health and safety and emphasize the primary responsibility of pet owners. However, significant differences exist in their legal systems, enforcement hierarchies, penalties, and the application of digital technology. People’s Republic of China employs a "central government sets principles as norms, local governments set regulations for implementation" model, utilizing administrative systems and digital technology for improved management. Conversely, Thailand uses a "criminal law establishes fundamental principles, integrated with regulations" model, where local governments have decision-making power and focus on addressing the root causes of problems. This research can be used to improve pet-related management policies in both countries and promote peaceful and hygienic coexistence between humans and pets.
