การศึกษาวิจัยเรื่อง “ปัญหาการขึ้นทะเบียนแรงงานต่างด้าวสัญชาติเมียนมาในตำบลดอนแก้ว อำเภอแม่ริม จังหวัดเชียงใหม่” มีวัตถุประสงค์เพื่อ 1) เพื่อศึกษากฎหมายและกระบวนการขึ้นทะเบียนแรงงานต่างด้าวสัญชาติเมียนมา ในตำบลดอนแก้ว อำเภอแม่ริม จังหวัดเชียงใหม่2) เพื่อศึกษาปัญหาและอุปสรรคในการดำเนินการตามกฎหมายเพื่อ ขึ้นทะเบียนแรงงานต่างด้าวสัญชาติเมียนมาร์ ตำบลดอนแก้ว อำเภอแม่ริม จังหวัดเชียงใหม่ 3) เพื่อให้ได้ข้อเสนอในการปรับปรุงกฎหมายและกระบวนการขึ้นทะเบียนแรงงานต่างด้าวสัญชาติเมียนมา ตำบลดอนแก้ว อำเภอแม่ริม จังหวัดเชียงใหม่

การวิจัยครั้งนี้ใช้วิธีการวิจัยเชิงคุณภาพ โดยอาศัยการสัมภาษณ์เชิงลึกแบบกึ่งโครงสร้าง (Semi-structured In-depth Interview)จากผู้ให้ข้อมูลหลัก (Key Informants) กลุ่มผู้ให้ข้อมูลหลักระดับอำเภอ (ในฐานะตัวแทนภาครัฐที่รับผิดชอบโดยตรง), ผู้นำชุมชน (ในฐานะผู้ใกล้ชิดแรงงานและเป็นตัวกลางระหว่างรัฐกับชุมชน) และ นายจ้าง (ผู้ที่มีหน้าที่และผลประโยชน์เกี่ยวข้องโดยตรงกับแรงงานต่างด้าว) นอกจากนี้ยังมีการศึกษาและรวบรวมข้อมูลจากการศึกษาจากเอกสาร รายงาน และข้อมูลทางวิชาการที่เกี่ยวข้อง ก่อนนำข้อมูลทั้งหมดมาวิเคราะห์เชิงเนื้อหาอย่างละเอียด

ผลการศึกษาพบว่า ปัญหาที่เกี่ยวข้องกับการขึ้นทะเบียนแรงงานต่างด้าวสัญชาติเมียนมาในพื้นที่ตำบลดอนแก้วเกิดจากหลายปัจจัยที่เชื่อมโยงกันอย่างซับซ้อน ซึ่งได้แก่ ความยุ่งยากและการปรับเปลี่ยนของขั้นตอนและข้อกำหนดทางกฎหมาย การขาดเอกสารแสดงตัวที่ถูกต้องและครบถ้วนของแรงงาน ส่งผลให้เกิดอุปสรรคต่อการลงทะเบียนเข้าสู่ระบบ นอกจากนี้ ยังมีอุปสรรคด้านภาษาและการสื่อสารที่ทำให้การสื่อความระหว่างแรงงาน นายจ้าง และเจ้าหน้าที่รัฐเกิดความเข้าใจผิด อีกทั้ง ความรู้และความเข้าใจของนายจ้างในกระบวน การและเงื่อนไขการขึ้นทะเบียนแรงงานยังไม่เพียงพอ รวมถึงข้อจำกัดด้านบุคลากรของเจ้าหน้าที่เมื่อเทียบกับจำนวนแรงงานในพื้นที่ และการขาดความต่อเนื่องในการประสานงานระหว่างหน่วยงานภาครัฐและชุมชน ปัจจัยทั้งหมดนี้ส่งผลให้กระบวนการขึ้นทะเบียนแรงงานในพื้นที่เป็นไปอย่างล่าช้าและขาดประสิทธิภาพ จากการวิจัยมีข้อเสนอแนะว่า ควรปรับปรุงกระบวนการขึ้นทะเบียนแรงงานต่างด้าวให้มีความชัดเจน เข้าใจง่าย และเหมาะสมกับสภาพบริบทของพื้นที่ สนับสนุนการเผยแพร่ข้อมูลที่ถูกต้องและเป็นระบบไปยังนายจ้างและผู้นำชุมชน รวมทั้งจัดทำสื่อประชาสัมพันธ์และช่องทางการสื่อสารในภาษาต่างๆ เพื่อลดปัญหาเรื่องภาษา พร้อมทั้งส่งเสริมการบูรณาการความร่วมมือระหว่างหน่วยงานภาครัฐและชุมชนในพื้นที่ เพื่อสร้างระบบการจัดการแรงงานต่างด้าวที่มีประสิทธิภาพและยั่งยืนมากยิ่งขึ้น

This research entitled “Problems of Registration of Foreign Workers, Myanmar Nationals in Don Kaew Sub-district, Mae Rim District, Chiang Mai Province” aims to: (1) examine the laws and procedures related to the registration of Myanmar migrant workers in Don Kaew Subdistrict, Mae Rim District, Chiang Mai Province; (2) study the problems and obstacles in implementing the laws and procedures for the registration of Myanmar migrant workers in the study area; and (3) propose recommendations for improving the laws and registration procedures for Myanmar migrant workers in Don Kaew Subdistrict, Mae Rim District, Chiang Mai Province.

This study employs a qualitative research approach. Data were collected through semistructured in-depth interviews with key informants, including district-level officials (as representatives of government agencies directly responsible for migrant worker administration), community leaders (as individuals closely connected with migrant workers and acting as intermediaries between the state and the community), and employers (who have direct responsibilities and interests related to migrant workers). In addition, relevant documents, reports, and academic sources were reviewed. All data were analyzed using content analysis.

The findings reveal that the problems related to the registration of Myanmar migrant workers in Don Kaew Subdistrict stem from multiple interrelated factors. These include the complexity and frequent changes in legal procedures and regulatory requirements, the lack of valid and complete identification documents among migrant workers, which hinders their ability to enter the registration system, and language and communication barriers that lead to misunderstandings among migrant workers, employers, and government officials. Furthermore, employers’ limited knowledge and understanding of registration procedures and conditions, insufficient numbers of officials relative to the volume of migrant workers, and the lack of continuous coordination between government agencies and local communities contribute to delays and inefficiencies in the registration process.

Based on the research findings, it is recommended that the registration process for migrant workers be improved to ensure greater clarity, simplicity, and suitability to local contexts. The dissemination of accurate and systematic information to employers and community leaders should be strengthened, along with the development of multilingual communication channels and public information materials to reduce language barriers. Moreover, enhancing integrated
cooperation between government agencies and local communities is essential for establishing an effective and sustainable migrant worker management system.
